Knox Smocks Terms and Conditions

These terms and conditions create a contract (the “Agreement”) between the consignor (“you” or “the consignor”) and Knox Smocks, LLC (“we” or “Knox Smocks”). Please review this agreement carefully. By registering to consign, you are agreeing to this contract, and it will remain in effect until you or Knox Smocks terminates the agreement. 

 

Items Accepted for Consignment:

New or gently used, high end children’s clothing items and accessories. Please see our list of acceptable brands. Additional brands may be accepted at the discretion of Knox Smocks. Additionally, larger baby items, such as high end high chairs, strollers, carriers, etc. may be accepted based on space availability and the discretion of Knox Smocks. Please reach out with any questions on acceptability. 


Items Not Accepted for Consignment:

-Items with obvious damage, I.e. holes, stains, tears, broken zippers, etc.

-Items that are in less than good condition 

-Mall brands or store brands, I.e, Carters, Old Navy, Cat and Jack, Granimals, etc.


Getting Started:

Prepare your items for drop off. Items can be shipped to us using a prepaid shipping label, or they may be dropped off at our location in Knoxville, TN. Additionally, Knox Smocks offers porch pickup for consignors within the local Knoxville area.

Items will be carefully reviewed by Knox Smocks. Items that are not accepted can be returned to you by self pickup or shipped to you ($10). If items are not picked up, they will be donated or used at the discretion of Knox Smocks.


Consignment Period:

Knox Smocks reserves the right to determine the consignment period of each item. Knox Smocks also reserves the right to discount or include any items in applicable sales.


Sales Price:

Knox Smocks determines the sale price, with commissions based on net sales price. Additionally, Knox Smocks will determine all markdowns, sales, and incentives, in order to consign at the highest price possible for the consignor. Knox Smocks uses market research to determine the best selling price for each item. 


Commission:

Unless otherwise stated, the consignor will receive 40% of the net sale price to be paid out, or 50% of the net sales price in store credit. Knox Smocks may adjust this percentage with prior notice. 


Consignor Payout:

Payments will be made via Check, Venmo, or Knox Smocks store credit. 

 

Ownership and Risk:

The consignor retains ownership of all items until they are sold by Knox Smocks. Knox Smocks assumes NO responsibility for ANY loss or damage once items are in the possession of Knox Smocks. Additionally, the consignor agrees and acknowledges that Knox Smocks,, its owners, employees, and volunteers assume no responsibility for the loss, theft, damage, or destruction of goods consigned with the shop, and expressly waives any claims against Knox Smocks arising from such events.

Indemnification:

The consignor agrees to indemnify and hold harmless Knox Smocks and its owners from all damages, suits, litigation, awards and costs, including but not limited to attorney's fees that may arise out of the display or sale of the Property for any reason whatsoever, including but not limited to civil or criminal claims regarding authenticity, legality, ownership, infringement of copywriter or trademark, or any other claim that may exist in law or equity. 

Unsold items:

Unless otherwise agreed upon by Knox Smocks and the consignor, all unsold items after their consignment period, as determined by Knox Smocks, become the property of Knox Smocks, to donate to a charity of their choice or to be used at the discretion of Knox Smocks. Please contact Knox Smocks to discuss other options for your unsold items.

 

By registering to consign with Knox Smocks, the consignor agrees to all terms expressed in the agreement above.
